asked the Minister for Lands and Agriculture if he is aware that legal proceedings have been threatened by the Land Commission against the Rev. J.K. Fitzgerald, Manister, Croom, Co. Limerick, if he does not pay interest in lieu of rent (Vandeleur Estate, 8096, V 337/4) for the November, 1923, instalment, notwithstanding that Rev. Mr. Fitzgerald holds a receipt for that instalment paid on November 14th, 1923.

The Deputy appears to be under a misapprehension. Legal proceedings have not been threatened by the Land Commission in respect of half-yearly interest in lieu of rent to 1st November, 1923, referred to in the question, which was paid as stated therein.

A further half-year's instalment was due on the 1st instant and a Receivable Order was recently issued to the payer to enable him to lodge the sum due in the Bank. The Receivable Order contained an endorsement which is now on all Receivable Orders to the effect that no further demand would be made, and that if the amount was not paid legal proceedings would be taken without notice.

Is the Minister aware that they threatened legal proceedings before the instalment was due, and does he suggest they have power to do that?

I have already stated that the instalment in respect of which legal proceedings were threat the ened was due on the 1st.

They threatened legal proceedings a fortnight before it was due.

I am not aware of that. That is a statement I will bring before the Minister for Agriculture.

He ought to look into the matter and see that tenants will not be harassed by these things——
