asked the Minister for Lands and Agriculture if he is now in a position to state the number of processes which have been issued by the State Solicitor for County Donegal at suit of the Land Commission as plaintiffs, for coming June Quarter Sessions, for (1) seventy-five per cent. compounded arrears of one year's rent; (2) two half-years' payment in lieu of rent, namely, 1st November, 1923, and 1st May, 1924; (3) one half-year's payment in lieu of rent, namely, 1st May, 1924; (4) for compounded arrears of rent and payment in lieu of rent already paid; (5) approximate costs of processes before and after entry.

The reply to the first query is nil, to the second 296, to the third 5, to the fourth nil. Apparently in some five cases of payment in lieu of rent the money was forwarded by the defaulters to the Land Commission before the processes had been served on the parties. As regards query 5, I am sending the Deputy a copy of the County Court scale of costs.

There is not much information in that. Arising out of that question, is the State Solicitor entitled to charge for processes issued but not served?

Arising out of that answer, is he entitled to charge for processes issued for payments already made?

Mr. HOGAN

He is entitled to charge for processes issued before payments are made.

As the Minister's answer to the question is very unsatisfactory I think I will raise it on the adjournment. It is as well to keep our eye on the Land Commission and the State Solicitor.
