Vol. 14 No. 16

CEISTEANNA—QUESTIONS. ORAL ANSWERS. - INCOME TAX CLAIM.

asked the Minister for Finance whether he is aware that the Revenue Commissioners have made a demand on Mrs. D. O'Sullivan, Currabower Mills, Lombardstown, for £221 10s. 0d. alleged to be due for Income Tax under Schedules D. 3758 and 8367, and have served notice of distraint; that Mrs. O'Sullivan states she is in a position to prove she has not sufficient means to meet the liability and did not make profits out of any business with which she was connected to warrant such assessment by the Revenue Commissioners, and is prepared to give the Commissioners any returns or information they require in connection with her business transactions, and whether he will investigate at an early date this case and cause distraint notice to be withdrawn pending investigation.

The answer to the first part of the question is in the affirmative. Owing to the provisions as to secrecy in Income Tax Acts cases of individual taxpayers are not suitable for discussion by way of question and answer in the Dáil, but as the matter has been raised I may say that Mrs. O'Sullivan did not appeal against the Income Tax assessments raised upon her, and, until notice of distraint was served, had completely ignored all Revenue communications. As regards the second part of the question, Mrs. O'Sullivan has now for the first time made certain representations through her solicitor. These representations are being considered on their merits by the Revenue Commissioners and are the subject of inquiries which have not yet been concluded.
