Mr. Tuite applied at Donadea Gárda Station on the 7th October last for a limited firearm certificate and tendered a postal order for 5/- in payment of the firearm certificate duty.

Limited certificates are issued only to occupiers of land who require a firearm for the purpose of killing animals and birds other than game on their own lands. Mr. Tuite is a labourer with only two acres of land and in accordance with their instructions the Gárda declined to issue to him a limited certificate. He refused to take out the full £2 certificate and the Gárda took possession of the firearm and returned to him the postal order tendered by him.

In order that he may have permission to keep a gun it is necessary for him either to bring himself within the terms under which a person can keep a gun at the 5/- rate, or else pay the full £2.
