asked the Minister for Finance why the award made by Judge Wyse-Power to C. Daly and Sons, Athenry, was not paid.

A report was made by the Circuit Judge under Section 15 of the Damage to Property (Compensation) Act, 1923, recommending payment to Mr. Christopher Daly of £740. It is the duty of my Department to examine recommendations of this kind, and after the fullest investigation in this case I found that the goods in respect of which the recommendation was made were not taken without the applicant's consent, and, moreover, that the case is one to which the terms of Section 9 of the Act apply. In these circumstances I was obliged to refuse to make any payment.

Is the Minister sure that as a result of his investigations the information supplied to him is correct?

I am sure, but I am always willing to get any further information.

Mr. JORDAN

Would the Minister accept a sworn affidavit to the contrary?

I would be interested to receive a sworn affidavit, and would consider it.
