CEISTEANNA—QUESTIONS. ORAL ANSWERS. - RETENTION OF GUN.

(Tipperary) asked the Minister for Justice whether he is aware that a gun, the property of Michael Carroll, Ballyanny, Nenagh, was seized by members of the Gárda Síochána in September, 1924, while Mr. Carroll and two other persons were fowling on Carroll's land; that all three persons were fined for the possession of guns without licences, but that no order was made that the guns be forfeited; whether he will state why Mr. Carroll's gun has been retained by the Gárda; what legal authority there is for retaining it; and whether he will give instructions to have Mr. Carroll's application for the return of his property reconsidered.

I have no information as to the seizure of a gun from Michael Carroll, Ballyanny, Nenagh. I have ascertained, however, that the Gárda Síochána seized the gun of Patrick Carroll, of Ballyanny, in circumstances similar to those stated by the Deputy, and in the subsequent Court proceedings the for feiture of the gun was ordered by the District Justice. This gun remained in the possession of the Gárda until the 13th ultimo, when it was restored to the owner on his making application for its return.
