asked the Minister for Fisheries whether the tenants on the Caddell Estate, at Kilree, Co. Sligo, are entitled to free bog on that estate; and, if so, whether he is prepared to remit to them the amount charged for turbary since the estate was vested in the Land Commission.

The Caddell Estate was not vested in the Land Commission. It was sold by the owner direct to the tenants under the Irish Land Act, 1903, and in the purchase agreements signed by the parties lodged in the Land Commission there was no reference to turbary.

The late Estates Commissioners when dealing with the estate asked the landlord to provide the lockspit turbary allotments for certain tenants on the townlands of Annaghmore and Doon. The landlord appointed an engineer for the purpose but owing to the attitude of some of the purchasing tenants he was unable to provide allotments and the holdings were vested in accordance with the purchase agreements signed by the parties. At the request of the Estates Commissioners the landlord executed a deed in respect of the bog in his own hands on the townland of Doon giving the Irish Land Commission the right to provide turbary thereon for persons nominated by them. The Land Commission will consider any representations made to them in connection with the turbary in question and determine whether it is necessary to make any regulations in respect of turbary rights.
