Vol. 25 No. 4

CEISTEANNA—QUESTIONS. WRITTEN ANSWERS. - LANDS FLOODED BY SHANNON.

asked the Minister for Fisheries whether his attention has been called to a report of the proceedings in the Carrick-on-Shannon Circuit Court, in the case of the Irish Land Commission v. Messrs. John Hunt and Michael McGrath, for rent of lands bordering the Shannon, alleged to be flooded; whether he is aware that the costs in connection with the half-yearly rent of £10 10s. 0d. in the case of Mr. John Hunt are £7 14s. 0d., and in that of Mr. Michael McGrath £7 14s. 6d., on a half-yearly rent of £12 7s. 4d.; whether, in view of the serious losses suffered by these and other farmers, whose lands adjoin the Shannon and are subject to flooding, he proposes to take steps to have their grievances remedied by a revision of the valuation of these lands for rating purposes and a reduction of the rents; and whether the Minister will consider the advisability of having remitted, or allowing for, the costs in the rents payable by the above-mentioned tenants.

The persons referred to are tenant purchasers, and as they did not pay the instalments due on 1st December, 1927, the Land Commission instructed the State Solicitor to take proceedings for their recovery. Decrees in both cases were granted at the last District Court held at Carrick-on-Shannon, and notice of appeal was lodged by the purchasers. The Land Commission have no power to make any reductions in the Land Purchase Annuities payable by tenant purchasers. The poor law valuation of the lands is a matter over which the Land Commission have no control.
