Ceisteanna—Questions. Oral Answers. - Ballina 1922 Shooting Incident.

asked the Minister for Defence if it is intended (a) to hold an inquiry into the shooting at Ballina, Co. Mayo, on the 10th December, 1922, of ex-Lieutenant Michael Foynes, at present residing at 55 Benburb Street, Dublin, and, if so, whether this man will be afforded an opportunity of giving evidence thereat; (b) if he will state why ex-Lieutenant Foynes and a number of witnesses were not present at the courtmartial which was held following the shooting; and (c) whether it is intended to award him a pension or gratuity in respect of his disablement caused by the shooting.

I am not aware that a courtmartial was held in connection with the wounding of Mr. Foynes. Owing to the lapse of time, it is not now intended to hold an inquiry such as the Deputy suggests. The case has already been the subject of investigation in connection with Mr. Foynes's claim for a pension, and as it was not established that he was wounded in the course of duty whilst on active service, without serious negligence or misconduct on his part, his claim under the Army Pensions Act, 1923, was disallowed. I regret that that decision must stand.
