Ceisteanna—Questions. Oral Answers. - Losses of Smallholders by the Raising of Lough Derg Level.

asked the Minister for Industry and Commerce whether he is aware of the fact that for some twelve months past the level of Lough Derg has been more than 110 feet above sea level, and that as a consequence more land than was anticipated has been either wholly or partially ruined, particularly in the parish of Woodford, and that money cannot compensate smallholders for the loss of three or four acres; and whether it is proposed to raise further the level of Lough Derg.

During the past twelve months the level of Lough Derg varied between 106.6 feet and 110 feet above sea level. On no occasion did it exceed the latter figure. The present level is 109.10. Under the present scheme of hydro-electric development it is not proposed to raise the level of Lough Derg above 110 feet.

Would the Minister state whether the Land Commission has been consulted regarding the position of smallholders whose holdings have been rendered uneconomic by the loss of two or three acres?

Caused by what?

Flooding.

Owing to the level being raised above 110 feet?

It has not been raised above 110 feet.

I agree. I have seen the charts. But 110 feet is higher than the level used to be before the Shannon Scheme was inaugurated. The consequence is that meadow lands which were not affected before are now injured, and there is a loss of two or three acres in many cases making the holdings uneconomic. I want to know whether or not the Land Commission would be consulted regarding compensation in these cases.

We would find it difficult to approach the Land Commission on the grounds that the level has been raised above 110 feet when in fact it has not been so raised.

It will be admitted in the E.S.B. offices that lands are now flooded in summer time that used not to be flooded.

I cannot accept any admission from the E.S.B. in regard to this matter.

Could the Minister say how long Lough Derg remains at its maximum level as compared with heretofore?

It certainly holds at the winter level some months longer than it used to do.
