asked the Minister for Lands and Fisheries whether in view of the recent decision of the Supreme Court in the case of the River Erne fisheries he can now make a statement on the present position of fishermen fishing the estuary of the River Erne.

As a result of the legal decision referred to the public right of fishing in the estuary of the River Erne is now established. Article 11 of the Constitution makes it necessary now to regulate the exercise of this public right. In the meantime any member of the public fishing for salmon in this estuary must comply with the existing law as regards licences, user of nets and close season.

The decision does not in any way affect the rights of fishing in the fresh water portion of the River Erne or in Lough Erne.
