Ceisteanna—Questions. Oral Answers. - Civilian's Claim for Compensation.

asked the Minister for Justice if he will state whether he is aware that Mr. Charles J. O'Hara, of Mount Prospect Avenue, Clontarf, received serious injury while giving urgently needed assistance to the Guards in the discharge of their duty at Vernon Avenue, Clontarf, on 1st February; that an application of his for compensation from the Dublin Corporation and the Dublin County Council was dismissed by the judge of the Dublin Circuit Court on the ground that his case did not come within the law, and he was not entitled to compensation; and if he will state whether he proposes to award Mr. O'Hara compensation.

I am aware that Mr. O'Hara received injury while assisting the Gárda Síochána and that an application made by him for compensation for malicious injuries was dismissed by the Circuit Court judge. Mr. O'Hara's solicitor gave notice of his intention to submit a claim for compensation to my Department. Consideration of the matter was postponed pending the result of Mr. O'Hara's claim for compensation for malicious injuries. The case is now receiving attention.
