Ceisteanna—Questions. Oral Answers. - Fishing By-Laws.

asked the Minister for Agriculture if he is aware that a case brought against the trawler Ely M.85, of Milford Haven, which was caught fishing actually inside the limits of Bantry Bay was marked "no jurisdiction," and costs were given against the State, owing to the fact that the law was not clearly defined; and if he will take steps to overhaul and strengthen our fishing by-laws to prevent the collapse of such prosecutions in future.

I am aware of the decision recorded in the case referred to. The points at issue are having consideration. They are not such as would be affected by fishery by-laws.

Arising out of the Minister's reply, was not adequate provision made in the recent Fisheries Act for such cases as are here referred to?

Yes, I should think so.

Is it the Minister's intention to appeal against the dismiss of the prosecution in this case?

Dr. Ryan

All these matters are under consideration.

So that the Minister is considering whether he will get a case stated, or appealed, to a higher court.
