Written Answers. - Payment of Annuities.

asked the Minister for Lands if he is aware of the fact that Mr. John Flynn, Lognavadogue, Turlogh, County Mayo, though willing to pay his annuity and unable to do so through the neglect of the Irish Land Commission to furnish him with a receivable order, has had demanded from him the amount due together with costs of notice 5/-, and costs of seizure £1 9s. 5d., by the sheriff for County Mayo; and if he is further aware that this is not an isolated case and that other annuitants have been similarly rendered unable to pay their annuities through the failure of the Irish Land Commission to furnish them with receivable orders, and in such cases is the Land Commission prepared to refund all costs and expenses, including sheriff's fees incurred by such annuitants, and, further, to ask the Minister if he is aware that the notice sent out by the sheriff was not addressed to Mr. John Flynn, but was in the name of his deceased father.

The Land Commission are not aware that John Flynn is in occupation of the holding referred to as he has not lodged documentary evidence of his title thereto. A receivable order for £2 3s. 5d. was issued in respect of the December, 1933, gale to William Flynn whose name appears in the Land Commission records and this instalment was paid and the receipted receivable order returned in the ordinary course. This receivable order made provision for payment of all gales to June, 1936, inclusive. The Land Commission records show that the instalment from June, 1934, to December, 1935, inclusive were paid by reference to the six-day notices issued to the tenant. Receivable orders are issued to all tenant purchasers and the Land Commission have no power to forego payment in any case of costs incurred by reason of default in paying the instalments of annuity as they accrue due.
