Vote on Account, 1940-41. - Suspension of Deputy.

(An Ceann Comhairle resumed the Chair.)

I understand the Deputy is dealing with the three officers concerned in the Magazine Fort. In one case proceedings are pending, and as to the other cases none of them should be discussed. The cases are sub judice.

I understand that in only one case are there proceedings pending.

The Chair is not prepared to hear the Deputy on that. There will be another opportunity. The Deputy had an opportunity on the Army Vote if he were here.

He was here.

The Deputy had an opportunity on the Vote for the Army when no proceedings were pending and the cases were not sub judice.

May I call attention to them?

The cases may not be discussed.

I want to clear up a misunderstanding. In your first remarks, Sir, you indicated that I had an opportunity if I were here. I was here.

The Chair did not intend to suggest that the Deputy was not in attendance in the House.

The Deputy believed he would have had an opportunity of raising the matter on the Adjournment. As you know, the fact that he could not do so was not conveyed to him until late. On the following day the Deputy believed he would have an opportunity on the Adjournment but he was again denied it. Now he is to be denied the opportunity of raising the matter here. If I cannot raise it at this time I will have to try to find some other method. In any case, as far as my voice is concerned, it will not be silent until it gets publicity.

The Deputy must sit down or keep away from these three cases.

I have not said a word about the three cases. It looks to me that if a Deputy raises anything inconvenient in the House it causes considerable commotion.

The Deputy must withdraw that remark reflecting on the Chair.

The Deputy will withdraw no remark.

The Deputy having refused to withdraw that remark I shall have to name him.

Do that if you please.

I move that Deputy William Norton be suspended from the service of the Dáil.

Is it in order to move that, having regard to the previous motion moved by the Minister that the Deputy be named. We have now two motions.

The Deputy was named by the Chair.

On the occasion on which you, from the Chair, stated that you named the Deputy, the Minister said: "I move that the Deputy be named". That motion, I submit, is before the House.

I have named the Deputy and the Minister moved, as laid down in standing order.

The Minister did move that he be named.

The matter is quite in order.
