asked the Minister for Defence whether the appeal of Patrick MacDonagh, Hawksford, Ballaghaderreen, County Roscommon, against decision refusing his application for I.R.A. pension for service with East Mayo Brigade has been decided; and, if not, when will it be.

A decision has been reached on the appeal lodged by Patrick MacDonagh, Hawksford, Ballaghaderreen, County Roscommon, for revision of the finding of the referee on his application under the Military Service Pensions Act, 1934, that the applicant is not a person to whom the Act is applicable. He will be notified of the result at an early date.

Is there any further appeal which is open to this man to have the facts in the case reviewed?

I take it that the Deputy means an appeal against the decision already given?

Yes, against the decision to which the Minister referred.

No, not unless there is new evidence available which was not available at the first hearing.

In which event the person can make a further application producing such further evidence as may be available?

Yes, producing such further evidence as was not available át the former hearing.
