Ceisteanna—Questions. Oral Answers. - Army Pensions Act.

asked the Minister for Defence if he is aware that Mrs. Hanley, 36 Parnell Street, Kilkenny, who made a claim under the Army Pensions Act in respect of her son, Private Thomas Hanley (E. 434278), who died in the course of his Army service, has been informed that her claim cannot be considered because it was not made within the statutory time limit; and that this woman, who is in poor circumstances, received no notification that a claim should be made within a specified time; and if he will, therefore, introduce amending legislation, making it possible for this claim, and others of the kind, to be heard.

The late Private Thomas Hanley died on the 2nd October, 1941. The latest date for application by his dependents for an award under the Army Pensions Act was within 12 months from the date of death or within 12 months from the date, 27th April, 1945, of the passing of the Act of 1943, whichever was the later.

Application should have been made by Mrs. Hanley therefore, before the 27th April, 1944. No application under the Acts has, in fact, been received from Mrs. Hanley, but in the event of new legislation amending the Army Pensions Acts being enacted, consideration will be given to Mrs. Hanley's claim with a view to allowing her to submit an application.
