Ceisteanna—Questions. Oral Answers. - Military Service Pension Regulations.

asked the Minister for Defence if he will state: (a) what regulations were made by him under the Military Service Pensions Act, 1934 to 1946; (b) what rules were made by each of the referees while they were in office; (c) the methods adopted to make applicants aware of such rules and regulations; (d) whether he will cause copies of these rules and regulations to be placed in the Oireachtas Library for the information of members of the Oireachtas and (e) whether the rules and regulations are available, in bound volumes, at the Stationery Office for the information of the legal profession.

As the reply is a somewhat lengthy one, I propose with the permission of the Ceann Comhairle and, with the Deputy's consent, to have it published in the Official Report.

Would the Minister say how many of these Orders are at present available in the Oireachtas Library?

Regulations 1 to 9 inclusive are included in the bound volume of Statutory Rules and Orders. Regulations Nos. 10 to 23 inclusive are at present being prepared in bound volume form and will be placed in the Oireachtas Library and the Law Library.

What is the total number of rules and regulations?

Twenty-three.

4. Statutory Rules and Orders No. 71 of 1935 — Referee (Military Service Pensions) (No. 2) Rules, 1935.

5. Statutory Rules and Orders No. 61 of 1936 — Referee (Military Service Pensions) (Amendment) Rules, 1936.

6. Statutory Rules and Orders No. 165 of 1936 — Military Service Pensions Act, 1934, Regulations, 1936.

7. Statutory Rules and Orders No. 99 of 1937 — Military Service Pensions Act, 1934, Regulations, 1937.

(b) No rules were made by any of the Referees during their tenure of office as the Referee is not empowered by Statute to make rules. The sole power of making rules regulating the procedure of the Referee is vested in the Minister.

(c) Regulations Nos. 1 to 12, inclusive, were published by the Stationery Office under the respective Statutory Rules and Orders Serial Nos. indicated and were on sale to members of the public at the Government Publications Sale Office. Regulations Nos. 13 to 23, inclusive, which dealt with the extension of the time limit for making application, were not so published but their contents were brought to the notice of the public by means of Press advertisements and radio announcements.

(d) and (e) Regulations Nos. 1 to 9 inclusive are included in the bound volume "Statutory Rules and Orders and Other Regulations made during period 1922 to 1938" which is available in the Oireachtas and Law Libraries. Regulations Nos. 10 to 23 inclusive are at present being prepared in bound volume form and will be placed in the Oireachtas and Law Libraries at an early date.
