Vol. 115 No. 4

Ceisteanna—Questions. Oral Answers. - Motor Accidents Compensation.

asked the Minister for Local Government whether he will examine the possibility of controlling the cost of or codifying claims and compensation resulting from accidents in which motor vehicles are involved.

asked the Minister for Local Government whether he is aware that the Road Traffic Act, 1933, does not stipulate that any person desiring to claim against a motor vehicle owner as a result of an accident should first justify his proposed action by the facts; and, if so, whether he will take steps, by the introduction of proposals for amending legislation, to ensure that insurance companies will not be obliged to settle "nuisance claims" regardless of merits, without admission of liability in order to avoid litigation and consequent expense and loss of time.

I propose, with the permission of the Ceann Comhairle, to take Questions Nos. 6 and 7 together. It is not clear from the terms of the Deputy's questions precisely what are the difficulties to which he refers or what Department is concerned. If the Deputy would care to give me fuller information in writing on the points he would wish to raise I shall be glad to have them examined.
