Vol. 154 No. 1

Ceisteanna—Questions. Oral Answers. - Eligibility of Deputies.

asked the Miniter for Local Government whether his attention has been drawn to a recent report concerning the possibility that an ancient Act of Parliament may affect the eligibility of certain members to sit in Dáil Éireann, and, if so, if he will make a statement on the matter.

I have seen articles in the newspapers concerning the possibility referred to by the Deputy. I am advised that Section 51 of the Electoral Act, 1923, had the effect of negativing earlier laws imposing disqualifications and that consequently the provisions of the Succession to the Crown Act, 1707, relating to the disqualification of office-holders for membership of the British House of Commons do not apply to membership of the Houses of the Oireachtas.
