Vol. 171 No. 4

Ceisteanna—Questions. Oral Answers. - Defence of Contributory Negligence.

asked the Minister for Justice when he proposes to introduce legislation to modify the defence of contributory negligence.

This matter is at present under consideration and I hope to bring proposals before the Government when I have disposed of certain other urgent legislative matters which are now in hands.

I regard that answer as most unsatisfactory. Is the Minister aware that legislation with this end in mind was introduced in this House in 1953? Since then, the matter has been raised with the Minister on a number of occasions. Is the Minister further aware that a Government Bill was ready in draft when the present Minister took office? In view of that, surely there is no reason why this legislation should not be introduced, particularly when the Government have obviously no business for the Dáil to do now?

There are very many reasons involved, some of which I have given. Other more urgent legislative matters are being attended to at the moment.

Sir, I should like to give notice of my intention to raise this matter on the Adjournment.

I shall communicate with the Deputy.
