asked the Minister for Industry and Commerce if he has power under Section 15 of the Holidays (Employees) Act, 1939, to make Orders requiring employers of certain classes of agricultural workers, such as horticultural workers, to keep records to show that the Act is being complied with; and if any such Order has been made.

5.

asked the Minister for Industry and Commerce if the Holidays (Employees) Act, 1939, applies to any of the following classes of horticultural workers, viz., workers employed (i) on fruit farms, (ii) in green houses, (iii) in nurseries, (iv) on bulb or flower farms and (v) as landscape gardeners.

With the permission of the Ceann Comhairle, I propose to take Questions Nos. 4 and 5 together.

I am empowered by the Act to make Records Orders in regard to any workers or classes of workers to whose employment the Act applies. The need for making any such Order has not arisen.

The Act does not, however, apply to agricultural workers; and horticultural workers are classifiable under the Act as agricultural workers, with the exception indicated in Section 2 of the Act.

Whether any particular person comes within the scope of these exceptions could be determined only in the light of all the circumstances of that person's employment.
