asked the Minister for Local Government if a county council is entitled to resume possession by court proceedings or otherwise of a cottage formerly erected by such council and subsequently vested in the then tenant under a purchase scheme, where the cottage is vacant and unoccupied for a considerable period, even if there are no arrears of instalments of annuity.

A county council is empowered by Section 24 of the Labourers Act, 1936, to apply for recovery of possession of a vested cottage by court proceedings where there has been a breach of any of the statutory conditions applicable to the cottage. These conditions are set out in Section 17 (2) (d) of the Act.

Have there been any proceedings of this kind by any local authority, to the Minister's knowledge?

I think there was one in Kildare but we do not seem to be able to retrieve the documents.
