Vol. 194 No. 10

Ceisteanna—Questions. Oral Answers. - Extinguishing of Publicans' Licences.

78.

asked the Minister for Justice if it is correct that a sum of £50,000 was paid as compensation under the terms of the Intoxicating Liquor Act, 1927 to publicans whose licences were extinguished under that Act; and if he will ensure that the terms of the Act are not negatived by the Intoxicating Liquor Act, 1960.

79.

asked the Minister for Justice (a) the number of intoxicating liquor licences which were terminated and for which compensation was paid under the Intoxicating Liquor Act, 1927, (b) the amount of compensation paid to the holders of such licences and (c) the number of such licences revived under the Intoxicating Liquor Act, 1960.

With the permission of the Ceann Comhairle, I propose to take Questions Nos. 78 and 79 together.

The number of licences extinguished under Part IV of the Intoxicating Liquor Act, 1927, was 299, for which a total of a little over £50,000 was paid in compensation.

The other parts of the Deputy's Questions seem to be based on a misunderstanding. Licences that were extinguished under the 1927 Act cannot be revived and premises to which such licences were attached cannot get new licences under any other provision of the Licensing Acts. This is provided for in section 41, subsection (3) of the 1927 Act.
