I do not consider that it would be appropriate to amend the Holidays (Employees) Act, 1961, for the purpose suggested by the Deputy.
If a worker's employment is suspended but not terminated, his entitlement under the Act depends on the outcome of the suspension. If the worker is reinstated, his service prior to suspension should count for entitlement to holidays in that employment year. If his employment is terminated, then he is entitled, under the Act, to holiday pay on the basis of his service prior to suspension.
