Mr. Ryan

asked the Minister for Industry and Commerce the present position regarding the request that he make an order under Section 3 (3) of the Holidays (Employees) Act, 1961, confirming the entitlement to annual holidays of full-time insurance agents paid by commission.

I have been advised that full-time insurance agents paid solely by way of commission are within the scope of the Act; that they are entitled to receive holidays with pay in accordance with the Act, and that there is, therefore, no need for regulations under Section 3 (3) of the Act to bring them within its scope. In July last I so informed the various employer and employee interests whom I had consulted in this matter.

Representations have since been made to me concerning difficulties which are stated to exist in relation to compliance with the Act by the agents' employers.

It is not yet clear what modifications of the Act, if any, will be proposed to me to meet these difficulties. It would not, however, be my intention to make any regulations to modify the Act without further consultation with both employer and employee interests.
