Vol. 197 No. 6

Ceisteanna—Questions. Oral Answers. - Donegal Compulsory Purchase Orders.

49.

andMr. Harte asked the Minister for Local Government the cause of the delay in sanctioning the following compulsory purchase orders submitted by the Donegal County Council: No. 614 Mrs. McCarry, Ballyboes, Falcarragh, No. 815 Mrs. Margaret Callaghan, Drung, Quigley's Point, No. 936 Patrick Shiels, White Hill, St. Johnston, No. 983 James Gallen (Con), Meenagoland, Killygordon, No. 991 Hugh McCarron, Craigadoes, St. Johnston, No. 1009 Mrs. Susan Harkin, Gortiness, Cloughan, and No. 1635 Patrick Donnelly, Liskey, Ballindrait.

I presume the Deputies' question refers to the Donegal County Health District Compulsory Purchase (No. 2) Order, 1962. There has been no undue delay in dealing with this Order.

Arising out of my inspector's report, further investigation by the county council of a number of the sites will be necessary before I can make a decision.

Could the Minister say when he will be most likely to decide on these compulsory purchase orders?

The position at the moment is that there are a number of outstanding detailed answers requested and required by my Department from the county council's engineering staff before we will be in a position to give final decisions on these orders. I understand these matters are being considered at the moment.

The Minister must be aware that in Donegal there is land that has not been administered and that the county council want absolute title. This has happened in many cases and the Minister must be aware that contractors actually went to the site and had the foundations dug, only to discover that the title was not in order. Now these unfortunate people must wait until the Department make up their minds to sanction these compulsory purchase orders. When the county manager has minutely examined them and the people who own the sites are agreeable to let them, I see no problem at all in some of these cases. I am not aware of them all, but in some of these cases, the Minister might give sanction.

The Deputy does not seem to see any problem in any case.

It is the Minister who does not see the problem.

The Minister usually has to find the cure for them.
