Vol. 199 No. 5

Ceisteanna—Questions. Oral Answers. - Defence Forces Personnel: Exemption from Civil Process.

37.

asked the Minister for Defence whether, in view of the widespread losses which have been sustained by creditors by reason of the exemption from civil process afforded to serving members of the Defence Forces by statute, he will consider amendment of the legislation at present in force so as to enable creditors to recover debts due to them.

I presume that the Deputy is referring to those provisions of the Defence Act, 1954, which exempt a man of the Permanent Defence Force or a Reservist called out on permanent service from civil process entailing committal to prison for private debt. Those provisions were re-enacted as recently as 1954 and I do not propose to introduce amending legislation.
