asked the Minister for Local Government how many appeals were made to the District Court under Section 52 of the Town and Regional Planning Act, 1934; and in how many cases notices were quashed by the District Court.
Section 52 of the Town and Regional Planning Act, 1934, deals with applications to the district court to quash notices issued by a local authority prior to their taking steps to enforce any provision of a planning scheme. Since no planning scheme has been brought into operation, no application to the district court could be made under Section 52.
