Mr. Ryan

asked the Minister for Posts and Telegraphs if, with reference to a reply of 12th March, 1963, he is aware that the publishers of the Legal Diary state that they had several complaints regarding the late delivery of the Diary on 28th February last; whether those complaints have been forwarded by them to his Department; and what action he proposes to take to have compensation paid to any persons who may have suffered loss and inconvenience by reason of late delivery of the Diary.

asked the Minister for Posts and Telegraphs whether, with reference to a reply of 12th March, 1963, he is aware that the publishers of the Legal Diary state that they had several complaints regarding the late delivery of the Diary on 28th February last; and what action he proposes to take in the matter.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 91 and 92 together.

I have already indicated that one issue of the publication in question suffered delay in the post. The issue affected was that of 28th February and particulars furnished by the publishers, including a number of letters from subscribers, show that copies of that issue were not delivered until the afternoon of the 28th or the morning of the 29th February. While such delays are regrettable and all reasonable precautions are and will continue to be taken to guard against them, the Post Office does not, and could not, undertake to pay compensation for inconvenience or loss arising as a consequence of the loss, damage, delay, non-delivery or mis-delivery of anything sent by post. A notice to this effect appears on page 58 of Volume I of the Post Office Guide.

Mr. Ryan

asked the Minister for Posts and Telegraphs if he will issue to the publishers of the Legal Diary a ceadúnas similar to the one issued to the ESB, thereby avoiding the daily waste of time involved in franking postal packets containing the Diary.

I cannot undertake to issue a licence of the kind in question before I have received an application for it from the firm concerned.
