Mr. Barrett

asked the Minister for Justice if there are any charges of personation or attempted personation pending in Cork city as a result of the recent general election; if so, the reasons why these have not yet been prosecuted; and if the intention is to prosecute them.

The answer to the first part of the question is "yes".

As regards the second part, the position is that the Garda Síochána do not take it on themselves to decide whether there should or should not be a prosecution in a case under the Electoral Acts. In accordance with standard practice, therefore, the Garda in Cork sought the directions of the law officers. The directions were received recently and are in course of being carried out.
