Vol. 217 No. 1

Ceisteanna—Questions. Oral Answers. - Purchase of Land by Non-Nationals.

63.

asked the Minister for Lands the number of farms and the acreage of each farm purchased by non-nationals in County Carlow for the past six years.

In County Carlow, since 1st August, 1961-the date from which particulars of relevant transactions have been officially recorded by the Land Commission under the procedure authorised by sections 33, 34 and 35 of the Finance Act, 1961-six properties, ranging from 10 acres to 94 acres and totalling 276 acres, were purchased by non-nationals subject to payment of 25 per cent stamp duty.

In addition, a 30-acre property was acquired for purposes of industry other than agricultural and three properties, comprising seven, 18 and 32 acres, respectively, were acquired for other purposes but exempted from the higher rate of stamp duty under the relevant provisions of the Finance Act.

64.

asked the Minister for Lands whether 25 per cent duty was paid by the alien purchaser in respect of the lands of the Kinsella Estate, Moneyguyneen, Kinnitty, Offaly; and if he will state the date on which the Land Commission approved of the purchase of these lands by a non-national.

It is understood that the contract for sale of this property was entered into before the passing of the Land Act, 1965. The purchaser is therefore not obliged to seek the consent of the Land Commission provided for in that section. The question of stamp duty will arise on presentation of the relevant instrument if and when the transaction is completed.
