asked the Minister for Local Government what action is being taken by Dublin Corporation, the Dublin Port and Docks Board and other relevant local authorities to prevent the erection of unauthorised structures or the destruction of local amenities pending the completion of a plan for the Dublin area under the Local Government (Planning and Development) Act, 1963.

The statutory basis for the planning control of development is the Local Government (Planning and Development) Act, 1963. The Act includes a number of enforcement provisions including provisions enabling planning authorities to secure the alteration or removal of unauthorised structures. I understand that Dublin Corporation has the use of these powers under consideration at present in a number of cases. In deciding whether to initiate such proceedings in any particular case, the corporation will, no doubt, have regard to the circumstances of the case, including the question whether the structure or other development is such that the planning authority would be prepared to give planning permission for it, on application being made for such permission.
