asked the Minister for Finance if he is aware of the great difficulties that have arisen with the interpretation of Part VII of the Finance Act, 1965 and the hardship and difficulties which it is causing those affected by it; and if he will take steps to amend this Part of the Act.

I am not aware that difficulties have arisen as respects the interpretation or application of the provisions of Part VII of the Finance Act, 1965. The Deputy will, however, appreciate that these provisions have been only a relatively short time in operation. If, after more extensive experience of their administration has been obtained, any question of the desirability of altering them becomes apparent, I shall of course be prepared to consider it.

Does the Minister suggest no representations have been made to the Department concerning the effect of Part VII, particularly in connection with the interpretation of disposal and the length of time a person may be in occupation? I understand there is a case pending where a firm acquired premises 80 years ago and are now obliged because of development to buy new premises and are being charged on the difference between the price 80 years ago and the value of the property at present.

I certainly got no representations on that specific point. Deputy Sweetman mentioned casually there were some difficulties in the interpretation of Part VII but did not specify what they were.

Perhaps if the Minister got representations he would have them considered?

This would be part of the procedure to which I referred in my reply. When these difficulties disclose themselves, I shall have them looked into.
