asked the Minister for Finance if, in order to avoid unnecessary expense, he will introduce legislation to provide that liability for estate duty and legacy duty on freehold registered land will in the case of a bona fide purchase for value from the personal representative attach to the purchase money, rather than to the land, so that the purchaser will take the land free from any such liability.

I regret I cannot see my way to introduce the legislation suggested by the Deputy, as the charge for duty on real estate, including freehold registered land is a most valuable safeguard so far as the collection of estate duty and succession duty is concerned. In referring to the avoidance of unnecessary expense the Deputy presumably has in mind the expense involved in obtaining a certificate of discharge from death duties. Since this certificate is obtainable free of charge from the Revenue Commissioners, the only expense involved is the solicitor's charge for obtaining it; and normally this constitutes only a small element in the vendor's total costs.
