asked the Minister for Health if he will take steps to ensure that shopkeepers will not be prosecuted for selling butter delivered to them by local creameries which has too much water content.

The prosecution of a shopkeeper for the offence of selling butter found to have an excess moisture is a matter for the local authority concerned.

There is provision under the Sale of Food and Drugs Acts, 1875-1936, whereby a shopkeeper can obtain a discharge from such prosecution by giving notice of and producing a written warranty from the suppliers that the butter complies with the appropriate requirements of the Acts.
