asked the Minister for Labour whether insurance agents who pay the usual social welfare contributions by way of deductions from their weekly incomes are regarded as employees for the purposes of entitlement to holidays under the Holidays (Employees) Act, 1961; and, if not, why.

The position of insurance agents under the Holidays (Employees) Act, 1961, depends, not on whether they are insurable under the Social Welfare Acts, but on whether or not they are employed under a contract of service. I would refer the Deputy to my reply to his question of 30th April last in which I outlined the High Court judgment in this matter.
