asked the Minister for Local Government if CIE are subject to the Planning Acts; whether permission was sought and granted in respect of the cement depot at the railway siding at the junction of New Cabra Road and Carnlough Road, Cabra, Dublin; and whether permission was given in respect of any other cement silos in Dublin supplied by CIE rail service.

CIE are subject to the provisions of the Local Government (Planning and Development) Act, 1963. By virtue of section 15 of the Town and Regional Planning Act, 1934, which was in operation at the date the development referred to was commenced, it was exempt from planning control. It would also have been exempted development under the 1963 Act.

I am not aware whether permission was granted in respect of any other cement silos in Dublin supplied by CIE rail services.

asked the Minister for Local Government if he is aware of the extreme nuisance and noise caused by the 24 hour shift of heavy lorries coming and going from a cement plant at Cabra, Dublin; and of the numerous complaints which have been lodged regarding this nuisance from the local residents; and what action he intends taking to remedy matters, bearing in mind the aggravation this system of work is causing to the traffic problem at the Phibsboro Road and North Circular Road junction.

asked the Minister for Local Government if he is aware that operations at the CIE cement silo at Cabra Road, Dublin are causing great disturbance to residents of that area; and if he will ensure that these operations will in future be carried out without causing any nuisance to local people.

With your permission, a Cheann Comhairle, I propose to take questions Nos. 27 and 28 together.

I have received no complaints that the operations of CIE at their cement depot at Cabra are causing nuisance through noise and disturbance. If the matters complained of are due to the driving of vehicles or are caused by the use of defective or badly loaded vehicles in a public place, the matter is one for the enforcement of the relevant Road Traffic Regulations by the Garda. Measures to deal with any traffic congestion arising would be for the Dublin Corporation and the Garda.

Would the Minister now accept this complaint of mine as an indication of complaints about the silo? People have probably made the mistake of sending complaints to CIE or to the Minister for Transport and Power but the Minister may be assured that local residents are much concerned about this matter and have asked me to complain.
