asked the Minister for Lands if he will state in expansion of a reply of 17th February, 1970, in relation to the appointed day for the purpose of the Land Act, 1923, the date of the first appointed day and the holdings affected by it and the latest appointed day and the holdings affected by it; and if any existing tenanted farmland is capable of being vested in the Land Commission under the vesting procedure in the Act of 1923 in the present circumstances.

The first holdings to vest in the Land Commission pursuant to the provisions of section 24, Land Act, 1923, did so on 1st November, 1924, which was the appointed day fixed in respect of each of ten tenanted land estates, comprising, in all, 22 holdings. Details of the holdings involved are set out in the appended table. This date was also the first appointed day fixed in respect of untenanted land, viz. the estate of Bridget Cannon, Record No. S.157, County Mayo. Notice of the fixation of all these appointed days was published in the issue of Irish Oifigiúil dated 14th October, 1924.

The latest appointed day fixed in respect of tenanted land was 15th August, 1969, on which date the holding of Mrs. Pauline Dumphy on the estate of Irene Bauer, Record No. S.25003, County Waterford, vested in the Land Commission.

The latest appointed day fixed in respect of untenanted land is 20th March, 1970, on which date the estate of Michael Kelly, Record No. S.24762, County Galway, will become vested in the Land Commission.

Although virtually all tenanted land, as defined in the Land Acts, has by now vested in the Land Commission, there was no statutory time limit on the operation of the provisions of section 24 of the Land Act, 1923 and, in fact, this section may still be applied to a holding which comes within the provisions of section 14 of the Land Act, 1931.

For the purposes of the Land Acts, tenanted land is defined in section 73 (2) of the Land Act, 1923, and section 2 of the Land Act, 1926. Further categories of land may be deemed to be tenanted land as provided in section 44, Land Act, 1931, sections 40 and 42, Land Act, 1933 and section 43 of the Land Act, 1936.
