asked the Minister for Justice how many prosecutions have been brought under the provisions of the Road Traffic (Construction Equipment and Use of Vehicles) Regulations, 1963 which relate to air pollution arising from motor vehicle exhaust fumes.
Ceisteanna—Questions. Oral Answers. - Road Traffic: Air Pollution.
31.
Separate statistics in respect of such prosecutions are not compiled. I understand from the Garda Síochána that the number of prosecutions is small.
Is the Minister satisfied these regulations are being properly enforced?
The gardaí make every effort to enforce them but they tell me there is a difficulty in proving offences because of the terminology used in certain of the articles in the 1963 regulations. I understand that the Minister for Local Government has the question of the possibility of amending the regulations also under consideration. I think the Deputy has a later question on that.
