asked the Minister for Local Government if he will consider designating as a special amenity area the space known as the Shelly Banks at the Great South Wall, Dublin Port.

This is a matter for Dublin Corporation. Only the planning authority may make a special amenity area order and my functions preclude me from initiating such action.

Is the Minister stating that the local authority should initiate making the order? Over seven years ago the then Dublin Corporation sought this order and it has still not been made. Is the Minister stating that only the corporation can initiate it?

Only the planning authority can initiate such an order. They have power to do so under section 42 of the Local Government (Planning and Development) Act, 1963.

If the order is made will the Minister sanction it?

If Dublin Corporation take the initiative and bring forward an amenity order for this area I shall consider it favourably.
