asked the Minister for Local Government if he is satisfied that local authorities have adequate power to deal with dumping on strands, especially during the summer season when children may cut their feet on broken bottles and when such dumping may give rise to offensive smells.

I am satisfied that local authorities have adequate legal powers to deal with dumping on strands. For instance, the Local Government (Sanitary Services) Acts, 1878 to 1964, enable sanitary authorities to take action against persons responsible for dumping matter which is a nuisance or injurious to health, and to make bye-laws for the prevention of nuisances arising from the deposit of rubbish. In addition, anti-litter bye-laws may be made by county councils and county boroughs and borough corporations pursuant to sections 125-127 of the Municipal Corporations (Ireland) Act, 1840 and section 16 of the Local Government (Ireland) Act, 1898. The provisions of the Local Government (Planning and Development) Act, 1963 also enable action to be taken against persons creating litter by dumping organic matter, rubbish, glass et cetera.

Would the Minister convey to his colleagues the desirability of introducing some type of regulation which will prevent the use of nonreturnable bottles which appear to be the biggest menace with regard to broken bottles?

That is a separate question.
