asked the Minister for Justice why no State proceedings were instituted in the case of a person in Dublin (details supplied) in respect of the non-payment by him and his organisation of the first prize of £100 to the winner (details supplied) arising from the raffle held on 20th October, 1970, under a permit granted by a Garda superintendent.

As the Deputy is aware, the complaint about non-payment in this case was investigated by the Garda, who sought the directions of the law officers, which were to the effect that proceedings would not be warranted. I have no function in relation to the initiation of criminal proceedings.
