asked the Minister for Lands if he will acquire land for a right-of-way into a farm (name supplied) in County Kerry as the person concerned was allotted land some time ago but has no access into the farm.

(Cavan): As the Deputy is aware, the Land Commission do not normally construct roads except for the immediate benefit of those being allotted lands. The person referred to in the question did not receive an allotment but, nevertheless, in the course of dividing lands in his vicinity the Land Commission did consider whether, as an act of grace, they could improve the access to two houses, of which his was one.

However, it was not possible to reach agreement with one of the tenants over whose holding the new road would pass. In any event, the situation has now changed to the extent that only one of the two houses concerned is occupied and the cost of providing the road would be out of all proportion to the benefit which would accrue.

In these circumstances the Land Commission have decided not to proceed further with the matter.
