Written Answers. - County Cavan Disability Benefit.

asked the Minister for Social Welfare why a person (name supplied) in County Cavan has not been paid disability benefit since July, 1976.

The disability benefit claim of the person referred to by the Deputy was disallowed from 8th July, 1976, following an examination by a medical referee who expressed the opinion that he was capable of work. The disallowance was upheld on appeal up to 5th November, 1976, the date of the latest medical certificate before the appeals officer. The claimant continued to submit medical certificates and as the certified incapacity is the same as that which appeared on the certificates during the disallowed period his claim continues to be disallowed.

asked the Minister for Social Welfare why social Welfare payments are delayed in cases where land has been genuinely transferred by way of family settlement or otherwise but the settlement cannot be registered due to title difficulties; and if he will arrange that such social welfare payments be made on production of a solicitor's certificate that a transaction has been carried out.

If land has been transferred by means of a family settlement or other instrument which has been duly stamped the transfer may be accepted for social welfare purposes. For this purpose it is necessary that the document should be inspected for any conditions it might contain such as the reservation of certain rights or payments to the transferor which would be relevant to the case and a solicitor's certificate could not, therefore, be normally regarded as sufficient evidence of a transfer.
