asked the Minister for Labour why a person (details supplied) was refused the balance of redundancy payments due to him after ceasing to work in the temporary position he had taken up, at less income than the redundancy payments, for a period of about 23 weeks, in view of the fact that he had been informed that he was entitled to the balance.

The redundancy weekly payment entitlement of the person in question before and after the temporary employment referred to were subject to the rule whereby the aggregate amount payable in unemployment benefit, pay-related benefit and redundancy weekly payment in respect of a week shall not exceed £50 or 85 per cent of his net average weekly earnings in the relevant tax year, whichever is the lesser. The total amount to which he became entitled subsequent to the temporary employment was less than the amount, £50, he had been entitled to prior to it. This was because the amount then payable to him in accordance with the relevant regulations was now governed by his earnings in the 1977-78 tax year instead of 1976-77 tax year. In the result a new relevant tax year applied, in which his earnings were substantially lower than in the previous year.
