asked the Minister for Industry, Commerce and Energy if he will sponsor legislation to amend the superannuation provisions of the Turf Development Acts to enable a manual worker employee of Bord na Móna to have an effective appeal to an independent agency arising from the refusal of Bord na Móna to allow an appeal to be considered by the Board's Superannuation Committee following a hearing before a Rights Commissioner on 20th July, 1977.

The appeal provisions of the Bord na Móna (Regular Works Employees) Superannuation Scheme are in my view effective and I do not, therefore, propose to introduce legislation to amend these provisions.

The case to which the Deputy refers is I understand a matter at issue between Bord na Móna and a former employee. The Deputy will perhaps recall that in reply to a question on 25th October I explained that the board had informed me that in relation to the claim from the former employee the matter at issue was heard by a Rights Commissioner on 20th July, 1977, and the hearing adjourned. The hearing has not since been resumed and no final recommendation has been made.
