asked the Minister for Agriculture if he is aware of the delay by the Land Commission in fencing a right-of-way for a person (name supplied) in County Galway.

It is not the intention of the Land Commission to fence the right-of-way in question. No provision for such fencing was made under the re-arrangement scheme carried out by the Land Commission in this area last year. I understand that the right-of-way, which is unfenced on one side, has been in use in its present condition for many years.

Either the Minister or some other people have not the up-to-date information in this case. I was in touch with the Land Commission earlier this week and they told me they were prepared to do this.

That is not the information I have been given, so there must be a conflict somewhere.

Would the Minister not agree that when the Land Commission are dividing land they abolish all rights-of-way entirely because of the many problems they create? Is the Minister further aware that in this case —I am not going to name the individual but the Minister has his name and address—they promised him that they would fence the right-of-way for him if he took part in a re-arrangement scheme for them?

I do not think that that is so. In the question of this right-of-way two people are involved.

I am aware of that.

The servient landowner would be opposed to any proposal to erect a fence. That is part of the problem.

Is the Minister aware that when the Land Commission were dividing the land—we are talking about a very small acreage—they promised this man that they would fence this right-of-way if he took part in a re-arrangement scheme?

I am not aware that any such promise was made to him. He was given assistance by way of grants and a loan for the erection of out-offices but I am not aware that any such promise was made to him.

Would the Minister investigate it further?

There is nothing in writing about it here. I will investigate it.
