The employer concerned has challenged the validity of the tribunal's determination of the employee's claim in this case.
Under section 10 of the Unfair Dismissals Act, 1977, where an employer fails to carry out a determination of the tribunal, the Minister for Labour is empowered, if he thinks it appropriate, having regard to all the circumstances, to institute proceedings in the Circuit Court on behalf of the employee for redress under the Act.
I am at present considering in consultation with the legal advisers, what further action can be taken in this matter, including the question of proceedings under section 10 of the Act.
