asked the Minister for Labour if he is aware that by virtue of the amending Act of 1971, the words "on the date of dismissal" have been deleted from Paragraph 1 (b) of the 3rd Schedule to the Redundancy Payments Act, 1967, but not from Paragraph 1 (a) of that Schedule; and the reason or significance for the different treatment given to these provisions.

The phrase in paragraph 1 (b) of Schedule 3 deleted by the 1971 Act was "on the date of his dismissal". It was deleted because its retention gave rise to conflict with paragraphs 13 and 21 of the Schedule.

The objective of the amendment was to remove any doubt that the "normal weekly remuneration" to be used in calculating lump sums was that at the date of declaration of redundancy, not date of dismissal.

The phrase "on the date of dismissal" in paragraph 1 (a) and repeated in paragraph 1 (b) has the same effect in each sub-paragraph. The phrase forms part of the clause "in whose employment he was on the date of dismissal" and qualifies "employer".
